1. ACCEPTANCE OF TERMS

All property transactions, negotiations, and final decisions remain the sole responsibility of the user. We facilitate discovery and analysis but do not execute transactions on behalf of users.

The information provided through our services is compiled from various sources that we believe to be reliable; however, we do not guarantee the accuracy, completeness, or timeliness of any information presented. Users are responsible for conducting their own due diligence and verification of all property information before making any investment or purchase decisions.

3. USER OBLIGATIONS

Users of Search Property services agree to the following obligations:

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our services.

You agree to provide accurate, current, and complete information when creating an account, scheduling appointments, or using our services. You must promptly update any information that changes.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to use our services only for lawful purposes and in accordance with these Terms. You will not:

- Use our services to engage in any fraudulent, deceptive, or illegal activity

- Attempt to gain unauthorized access to our systems or networks

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Users may schedule appointments for consultations, property analysis sessions, or other services offered by Search Property through our designated scheduling system or by contacting us directly.

Scheduling: Appointments are subject to availability and must be scheduled at least 24 hours in advance unless otherwise agreed upon. We will confirm all scheduled appointments via email or phone.

Cancellations by Users: If you need to cancel or reschedule an appointment, you must provide at least 24 hours advance notice. Cancellations or rescheduling requests with less than 24 hours notice may result in forfeiture of any fees paid or the assessment of a cancellation fee, as specified in your service agreement.

No-Show Policy: Failure to attend a scheduled appointment without prior cancellation ("no-show") may result in forfeiture of fees paid and may affect your ability to schedule future appointments.

Cancellations by Search Property: We reserve the right to cancel or reschedule appointments due to emergencies, unforeseen circumstances, or other factors beyond our control. In such cases, we will make reasonable efforts to notify you as soon as possible and will work with you to reschedule or provide a refund as appropriate.

Late Arrivals: If you arrive more than 15 minutes late to a scheduled appointment, we reserve the right to treat the appointment as a no-show and may require rescheduling.

5. PAYMENT TERMS

Fees: Fees for services provided by Search Property vary depending on the specific service, scope of work, and duration of engagement. All applicable fees will be communicated to you before you commit to any paid service.

Payment Methods: We accept payment via credit card, debit card, bank transfer, or other payment methods as specified during the transaction. By providing payment information, you represent that you are authorized to use the designated payment method.

Payment Timing: Payment is generally required at the time of service booking unless alternative arrangements have been agreed upon in writing. For ongoing services or subscriptions, payment will be charged on the schedule specified in your service agreement.

Subscription Services: Some services may be offered on a subscription basis with recurring charges. By subscribing, you authorize us to charge your designated payment method on a recurring basis until you cancel the subscription. You may cancel your subscription at any time through your account settings or by contacting us, but cancellation will be effective at the end of the current billing period.

Refund Policy: Fees paid for services are generally non-refundable except as required by law or as specifically stated in your service agreement. If we cancel a scheduled appointment or fail to deliver contracted services, you may be entitled to a refund of fees paid for those specific undelivered services.

Late Payment: If payment becomes overdue for any service, we reserve the right to suspend or terminate your access to services until payment is received. Late payments may incur additional fees or interest charges as permitted by law.

Price Changes: We reserve the right to modify our fees and pricing structure at any time. Price changes will not affect services already purchased but will apply to future purchases following notice of the change.

Taxes: All fees are exclusive of applicable taxes, duties, or other governmental charges. You are responsible for paying all such taxes associated with your use of our services.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Search Property, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of opportunity, or investment losses, arising out of or relating to your use of our services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of our services shall not exceed the total amount of fees paid by you to Search Property in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

Search Property does not guarantee any specific results, returns on investment, property appreciation, rental income, or financial outcomes from the use of our services. Real estate investments involve substantial risk, and property values may decrease as well as increase. Past performance and historical data do not guarantee future results.

We are not responsible for:

- Decisions you make based on information obtained through our services

- Errors, inaccuracies, or omissions in property listings, market data, or other information

- The condition, legal status, or suitability of any property identified through our services

- Actions or omissions of third parties, including property sellers, real estate agents, lenders, or other service providers

- Technical difficulties, service interruptions, or data loss

- Unauthorized access to your account or data due to your failure to secure your credentials

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

7. WARRANTY DISCLAIMERS

THE SERVICES PROVIDED BY SEARCH PROPERTY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SEARCH PROPERTY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Search Property does not warrant that:

- Our services will meet your specific requirements or expectations

- Our services will be uninterrupted, timely, secure, or error-free

- The information provided through our services will be accurate, reliable, complete, or current

- Any defects or errors in our services will be corrected

- Our services are free from viruses or other harmful components

No advice or information, whether oral or written, obtained by you from Search Property or through our services shall create any warranty not expressly stated in these Terms.

We do not warrant the performance or suitability of any property identified through our services. All properties are subject to change, prior sale, or withdrawal from the market without notice. Property descriptions, photographs, measurements, and other information are provided by third parties and may contain errors or be outdated.

We make no representations or warranties regarding the financial projections, investment analyses, or market assessments provided through our services. All such information is based on assumptions, estimates, and historical data that may not accurately predict future performance.

You acknowledge that real estate markets are subject to fluctuation and that property values, rental rates, and investment returns can be affected by numerous factors beyond our control or prediction.

8. GOVERNING LAW

These Terms and any disputes arising out of or relating to these Terms or your use of Search Property services shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of competent jurisdiction in the applicable location, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

The failure of Search Property to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with any additional agreements or policies referenced herein, constitute the entire agreement between you and Search Property regarding the use of our services and supersede all prior agreements and understandings.
